The following conditions apply

The terms and conditions apply to all current and future business relationships.

Differing, conflicting or supplementary general terms and conditions of the customer do not become part of the contract - even if they are known - unless their validity is expressly agreed to in writing. With the order, the customer declares bindingly that he wants to purchase the ordered goods. The goods remain the property of the company until full payment has been made. Neureiter Maschinen GmbH.

The place of fulfillment for both delivery and payment is the Kuchl warehouse. The agreed place of jurisdiction is 5400 Hallein, Austria. Austrian law applies without reference standards to foreign law. In the event that the Neureiter Maschinen GmbH If the contract is transferred to a sales partner, their distribution warehouse, their registered office and their national law are decisive.

Payment

The receipt of payment by the seller is decisive for the timeliness of payment.
In the event of late payment, the seller will be charged interest of up to 1% per month and processing fees of up to EUR 10,00 per reminder. Any offsetting against claims of the seller is excluded. The buyer is not entitled to withhold or retain only part of the purchase price.

If the buyer is an entrepreneur or corporate customer, he must inspect the goods immediately and report any defects in writing within 8 days at the latest; otherwise, due claims will expire. In the case of obligations resulting from non-performance or poor performance, the seller is responsible for choosing how to fulfill them. This does not apply to consumers, as their claims and rights are covered by the warranty.

The agreed quality of the subject matter of the contract owed by the seller arises exclusively from the contractual agreements with the customer and not from other promotions, advertising, brochures, etc. The customer does not receive any guarantees in the legal sense.

Right of withdrawal for online orders

If the buyer is a consumer, they are entitled to withdraw from an online order within 14 working days without giving any reason. This period begins upon receipt of the goods by the buyer and is met upon dispatch of the declaration. Saturdays are not considered working days for the purpose of calculating this period. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post, fax, or email) using the contact details below.

In the event of a cancellation, all payments we have received from you, including delivery costs, will be refunded promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. Delivery costs will, of course, only be non-refundable if you have chosen a delivery method other than the cheapest standard delivery offered by us. We will use the same payment method you used for the original transaction as the method of payment for the refund, unless you expressly request a different payment method. There are no additional fees for the refund. 

Please return the goods you have purchased to us immediately. The goods must be returned or handed over to us no later than 14 days from the date on which you notified us of the cancellation of this contract. Please note that this deadline will only be considered met if the goods were dispatched before the expiry of the fourteen-day period.

You will bear the direct costs of returning the goods. According to the terms and conditions, you are only liable for any loss of value of the goods resulting from handling other than what is necessary to check their quality, properties, and functioning.

A revocation of goods is excluded if the delivered goods, due to their nature, have been inseparably mixed with other goods, have been manufactured according to customer specifications or have clearly been made to customer-specific specifications.fischtailored to your personal needs.

Delivery

All deliveries to an entrepreneur are made ex warehouse at the risk and expense of the entrepreneur. If the goods are sent, set up or installed at the entrepreneur's request, the risk of accidental loss or accidental deterioration passes to the entrepreneur when they leave the shipping warehouse, regardless of whether the shipment takes place from the place of performance and who bears the freight costs carries.

If the customer is a consumer, the risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the consumer when the item is handed over. If the customer does not accept the goods on time and if he expressly or tacitly refuses to accept them even after a reasonable grace period has been set, the seller can withdraw from the contract or demand compensation for non-performance. 

In the event of delivery delays due to circumstances for which the seller is not responsible, the customer is only entitled to withdraw from the contract if, after the agreed delivery period has expired, he sends a written warning about delivery and then within a further reasonable grace period, starting from the day of receipt of the written notice Notice of default not given. Customer claims for damages are excluded.

Partial delivery

The majority of our items are available for immediate delivery from warehouse A-5431 Kuchl, the rest are usually available within a few days. With his order, the customer allows these to be delivered in split shipments on a case-by-case basis. Of course, we only charge the stated packaging and shipping costs once. (There are no shipping costs in Austria for catalog goods orders with a gross weight of up to 30 kg.)

Legal provisions

The company Neureiter Maschinen GmbH, Kellau 167, A-5431 Kuchl sells or you as a customer buy the goods you have selected at the respective price. The Neureiter Maschinen GmbH is entitled to transfer or transfer all rights and obligations to local parties with a debt-discharging effect, in particular the data required for payment processing. The contract is based on the General Terms and Conditions (GTC). The buyer expressly confirms that he has taken note of and accepts this and in particular the right of withdrawal and its consequences in accordance with the paragraph “Right of withdrawal for consumers”.

Price, typesetting and printing errors or technical changes to products

The company Neureiter Maschinen GmbH points out that despite careful maintenance of print media and online media, errors cannot be completely ruled out. We therefore reserve the right to make typesetting, pricing and printing errors in catalogues, brochures, price lists and websites at any time. Furthermore, product images in catalogs or in the online shop may differ from the actual product presentation and technical changes by suppliers are possible at any time. 

For online shop orders, the customer receives an automated letter about the order receipt via email. This is merely a confirmation of receipt of the order, which is viewed as a binding offer to purchase from the customer. A valid purchase contract is only concluded when a separate order confirmation is sent or the goods are delivered.
The Neureiter Maschinen GmbH reserves the right not to accept or process orders in exceptional cases. 
In the event of a pricing error(s) in the order, the company will be contacted Neureiter Maschinen GmbH inform the customer immediately about the actual price, in which case the customer can expressly confirm his offer at the communicated price again in writing or implicitly by paying the same. Otherwise it is Neureiter Maschinen GmbH entitled to withdraw from the contract (if the contract has already been accepted.)
